Bail before arrest
ضمانت قبل از گرفتاری
Criminal
Bail before arrest is bail sought for a person in a case already registered against them before the person is arrested; the Code of Criminal Procedure does not use that phrase.
What does Bail before arrest mean in plain words?
The Code does not use the words 'pre-arrest bail'. Section 498 lets the High Court or the Court of Session direct that any person be admitted to bail. Section 498A says sections 497 and 498 do not require or authorise a court to grant bail to a person who is not in custody, is not present in court, or against whom no case stands registered at that time, and that an order or direction for bail is effective only for the registered case specified in it. How these provisions are applied to a person who has not been arrested is for the courts to decide and is not covered here.
