Suo motu
ازخود نوٹس
Constitutional
Suo motu is when a court acts on its own initiative, without a petition from a party. Under the current Constitution this power is narrow.
What does Suo motu mean in plain words?
Article 184, which the Supreme Court used for suo motu notice of public-interest matters, has been omitted by the 27th Amendment (2025). Now the Federal Constitutional Court can enforce Fundamental Rights on a question of public importance only on an application filed by a person, and a High Court cannot go beyond what an application asks. The Federal Constitutional Court may, on its own motion, call for the record of a pending case that raises a substantial question about interpreting the Constitution.
When will I hear Suo motu?
The Federal Constitutional Court called for the record of a case pending in a High Court because it raised a substantial question about interpreting the Constitution.
Which law covers Suo motu?
Articles 175E(3) and (5) and 199(1A), Constitution of Pakistan 1973
