Constitutional
A writ petition is an application to a High Court under Article 199 of the Constitution, asking it to direct a person performing public functions to act lawfully, or to enforce a Fundamental Right.
What does Writ petition mean in plain words?
A High Court can act under Article 199 only if it is satisfied that no other adequate remedy is provided by law. The Article covers persons performing functions for the Federation, a Province or a local authority, people held in custody, people holding public office, and the enforcement of Fundamental Rights. The Constitution does not use the word writ; it describes the kinds of order the court may make. The court cannot go beyond what the application asks, and members of the Armed Forces cannot use it for their terms of service.
