Civil
A stay order is a court order that temporarily stops an action or proceeding, such as an eviction, a demolition or the implementation of another order.
What does Stay order mean in plain words?
A stay does not decide the case. It freezes the position until the next date or until the court says otherwise. To stop a decree being executed while an appeal is pending, the applicant must show that substantial loss may result, that he applied without unreasonable delay, and give security (Order XLI rule 5).
When will I hear Stay order?
The High Court granted a stay against the demolition till the next hearing.
Which law covers Stay order?
Order XXXIX and Order XLI rule 5, Code of Civil Procedure 1908; Section 94, Code of Civil Procedure 1908
