Court procedure

Limitation is the legal time limit within which a suit, appeal or application must be filed, after which the court will normally refuse to hear it.

What does Limitation mean in plain words?

The clock runs from a fixed event, like the date of a breach or a judgment. For example, under the Limitation Act a suit for money lent must be filed within three years, and an appeal under the Civil Procedure Code to the District Judge's court within 30 days. In the Punjab, suits on loans are governed by the Punjab Loans Limitation Act 1904, so the period there can differ. A court can admit a late appeal or application if there is sufficient cause.

When will I hear Limitation?

The suit was dismissed as time-barred, having been filed after the limitation period expired.

Which law covers Limitation?

Limitation Act 1908; Section 5 (extension of period); in the Punjab, suits on loans: Punjab Loans Limitation Act 1904

Common questions about Limitation

Can a case be filed after the limitation period?
The court will usually dismiss it as time-barred. In some cases delay can be excused for sufficient cause, or the period may start later; whether either applies depends on the facts and the law that governs the claim.
